Barkhalla Labs Terms

These terms apply to Barkhalla Labs (labs.barkhallastudios.com), run by Barkhalla Studios GmbH, Helmholtzstrasse 9, 22765 Hamburg, Germany ("we", "us"). By playing Labs games or joining the membership, you accept them.
1. What Barkhalla Labs Is
Barkhalla Labs is a collection of small games and experiments made by our studio. Some are free to play in your browser. The others are for members.
Labs games are experiments. They can be short, unfinished, or change between versions. We may update or remove games, and add new ones, at any time.
2. Your Account
You do not need an account to play the free games. You need a Barkhalla account to sync your saves, rate games and become a member. One account works across all Barkhalla sites.
Keep access to the email address of your account: we log you in with codes sent to it. You can delete your account at any time in your account settings.
3. The Membership
What is included. While your membership is active, you can play every members' game and experiment in your browser and download the available builds.
Price and payment. The membership costs USD 3 per month, or USD 30 per year if you choose yearly billing, including taxes. It may be shown in your local currency at checkout. The membership is sold through Link, operated by Stripe, which acts as the reseller (merchant of record). Your purchase contract is with Link: payment, receipts, invoices, refunds and statutory withdrawal rights are handled under Link's terms, which you accept at checkout:
Free trial. If you have never been a member, your membership starts with a free trial of 7 days. You give a payment method at checkout, but nothing is charged during the trial. If you cancel before the trial ends, you pay nothing. Otherwise the paid membership starts automatically when the trial ends, at the price shown at checkout. Link reminds you by email before the trial ends. The free trial is available once per person and account.
Renewal. The membership renews automatically at the end of each billing period (every month, or every year on yearly billing) until you cancel it.
Cancelling. You can cancel at any time in your account settings ("Manage subscription") or in your Link account. After cancelling, you keep access until the end of the period you have paid for (the month, or the year on yearly billing). Deleting your Barkhalla account also cancels the membership.
Failed payments. If a renewal payment fails, your access continues for a few days while the payment is retried. If it keeps failing, the membership ends.
Refunds. Refund requests are handled by Link support. You can also write to us at contact@barkhallastudios.com, and we will help.
Price changes. If we change the price, we will tell you in advance by email. The new price applies from your next renewal after that notice, and you can cancel before it does.
4. Downloads
Members can download builds of members' games. You may install and play them on your own devices for personal, non-commercial use. They contain no copy protection, and you can keep playing the versions you downloaded after your membership ends.
You may not sell, share publicly, re-upload or distribute the games or their content.
5. Saves
When you play a supported game while logged in, its saves are stored with your account so you can continue on another device. We do our best to keep them safe, but games are experiments: please do not rely on Labs saves as your only copy of anything important.
6. Ratings and Feedback
You can rate games you have access to. Only the totals are public. Feedback you write is sent privately to the studio. Please keep it respectful: we may remove ratings and block accounts that abuse the service.
7. Acceptable Use
Do not try to access games or files you have no access to, interfere with the service, or use bots to rate games. We may suspend or delete accounts that break these rules. If we end a paid membership for this reason, the membership is cancelled at the end of the current period.
8. Ownership
All games, art, music and texts on Barkhalla Labs belong to Barkhalla Studios GmbH or its licensors. The membership gives you the right to play them as described in these terms, nothing more.
9. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence, we are liable only for breaches of essential contractual obligations (obligations that make the service possible at all and that you may rely on), limited to the damage that is typical and foreseeable for this kind of service. Otherwise, our liability is excluded.
10. Changes to These Terms
We may update these terms, for example when we add features. We will announce changes that affect members by email at least 30 days before they take effect. If you do not agree, you can cancel your membership before then.
11. Law and Disputes
German law applies. If you are a consumer living in another country, you keep the protection of the mandatory consumer laws of that country.
We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
